この使用許諾契約（以下「本契約」）は、Mamonis（以下「当方」）が提供する iOS アプリ「murmur」（以下「本アプリ」）を使用する条件を定めるものです。本アプリをインストールまたは使用することで、本契約に同意したものとみなします。本契約は Apple の標準 EULA（Licensed Application End User License Agreement）に代わるものであり、その最低限の条件を含みます。

1. 使用許諾

当方は、ユーザーに対し、本契約に従うことを条件として、ユーザーが所有または管理する Apple ブランドの製品上で本アプリを使用する、非独占的・譲渡不能の権利を許諾します。本アプリを複製、改変、配布、再許諾、貸与、リバースエンジニアリングすることはできません。

2. ユーザー生成コンテンツと不適切な内容の禁止（ゼロトレランス）

本アプリはユーザーが投稿した内容（mur・mark・告知・写真）を他のユーザーに表示します。当方は、以下の内容および行為を一切容認しません。

ユーザーは、本アプリ内の通報機能ですべての投稿を通報でき、他のユーザーをブロックできます。当方は通報された投稿を 24 時間以内に確認し、違反する投稿を削除し、違反したユーザーの利用を制限または停止します。違反の程度によっては、端末単位での永久利用停止を行います。

3. 位置情報と写真

本アプリは、投稿を置くときに位置情報を使用し、端末内でずらしてから送信します。写真は本アプリのカメラでその場で撮ったものだけを受け付け、メタデータを取り除いてから送信します。詳細はプライバシーポリシーに定めます。

4. アプリ内課金

本アプリの有料プランは Apple のアプリ内課金（自動更新サブスクリプション）により提供されます。購入・更新・キャンセル・返金は Apple の規定に従います。

5. 保守とサポート

本アプリの保守およびサポートは当方が行います。Apple は本アプリの保守・サポートの義務を負いません。お問い合わせは https://mamonis.studio/contact よりお願いいたします。

6. 保証

当方は、法律で認められる最大限の範囲で、本アプリに関する明示または黙示の保証を行いません。本アプリが適用される保証に適合しない場合、ユーザーは Apple にその旨を通知することができ、Apple は本アプリの購入代金（ある場合）を返金します。法律で認められる最大限の範囲で、Apple は本アプリに関するその他の保証義務を負いません。

7. 責任

本アプリまたはその使用に関するユーザーまたは第三者からの請求（製造物責任、法令適合性、消費者保護法その他に基づく請求を含みます）への対応は当方が行い、Apple は責任を負いません。当方の責任は、適用法で認められる範囲で、本契約および利用規約に定める範囲に限られます。

8. 知的財産

本アプリに関する第三者からの知的財産権侵害の主張に対する調査・防御・解決は当方が行います。地図データは OpenStreetMap contributors（ODbL）によるものです。

9. 輸出規制・法令遵守

ユーザーは、米国政府の禁輸対象国に居住していないこと、および米国政府の取引禁止対象者リストに載っていないことを表明します。ユーザーは本アプリの使用にあたり、適用される法令を遵守するものとします。

10. 第三者受益者

Apple および Apple の子会社は本契約の第三者受益者であり、ユーザーが本契約に同意した時点で、Apple は第三者受益者として本契約をユーザーに対して執行する権利を有します。

11. 準拠法

本契約は日本法を準拠法とし、本アプリに関する紛争は当方の所在地を管轄する裁判所を専属的合意管轄とします。

12. 本契約の変更

当方は必要に応じて本契約を変更することがあります。変更後の本契約は本ページに掲載した時点で効力を生じます。

End User License Agreement

This End User License Agreement (the "Agreement") sets out the conditions for using the iOS app "murmur" (the "App") provided by Mamonis ("we"). By installing or using the App you agree to the Agreement. The Agreement replaces Apple's standard Licensed Application End User License Agreement and includes its minimum terms.

1. Licence

We grant you a non-exclusive, non-transferable licence to use the App on Apple-branded products that you own or control, subject to the Agreement. You may not copy, modify, distribute, sublicense, lease or reverse engineer the App.

2. User-generated content and zero tolerance for objectionable content

The App shows content posted by users (murs, marks, notices, photos) to other users. We do not tolerate:

Violence, threats, harassment, hate speech or discrimination
Sexual content or graphic violence
Exposing someone's personal information
Spam, advertising or solicitation
Content that encourages self-harm or harm to others
Content that harms or sexualises children (immediate permanent ban and report to the authorities)

You can report any post and block any user from within the App. We review reported posts within 24 hours, remove violating content and restrict or ban violating users, up to a permanent device-level ban.

3. Location and photos

The App uses your location when you place a post and shifts it on the device before sending. Only photos taken on the spot with the App's camera are accepted, and metadata is removed before upload. See the Privacy Policy.

4. In-app purchases

The paid plan is provided through Apple's in-app purchase (auto-renewable subscription). Purchase, renewal, cancellation and refunds follow Apple's policies.

5. Maintenance and support

We are responsible for maintenance and support of the App. Apple has no obligation to provide maintenance or support. Contact: https://mamonis.studio/contact

6. Warranty

To the maximum extent permitted by law, we make no express or implied warranty regarding the App. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the App (if any). To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.

7. Liability

We, not Apple, are responsible for addressing any claim by you or a third party relating to the App or your use of it, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer protection or similar law. Our liability is limited as set out in the Agreement and the Terms of Use, to the extent permitted by law.

You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties. You must comply with applicable laws when using the App.

10. Third-party beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of the Agreement, and upon your acceptance Apple has the right to enforce the Agreement against you as a third-party beneficiary.

11. Governing law

The Agreement is governed by the laws of Japan, and any dispute is subject to the exclusive jurisdiction of the court having jurisdiction over our location.

12. Changes

We may update the Agreement. Updates take effect when posted on this page.
